Job Description

Role Summary: We are seeking a highly experienced Bankruptcy Specialist to manage and oversee the complexities of bankruptcy proceedings for our foreign multinational corporation's operations within India. This role requires a deep understanding of Indian insolvency laws, corporate restructuring, and financial advisory services, particularly as they pertain to foreign entities operating in the Indian market. The specialist will be instrumental in navigating legal frameworks, protecting stakeholder interests, and ensuring compliance throughout the bankruptcy process.

Key Responsibilities:

  1. • Advise on and manage all aspects of insolvency and bankruptcy proceedings under the Insolvency and Bankruptcy Code (IBC) of India.
  2. • Conduct thorough due diligence on financial health and legal standing of the Indian subsidiary/operations.
  3. • Develop and implement strategic plans for debt resolution, restructuring, or liquidation.
  4. • Liaise with legal counsel, financial advisors, regulatory bodies (e.g., NCLT, IBBI), and other stakeholders.
  5. • Prepare and file necessary documentation with Indian courts and tribunals.
  6. • Manage creditor negotiations and settlement discussions.
  7. • Ensure compliance with all applicable Indian laws and regulations related to corporate finance and insolvency.
  8. • Provide expert advice on cross-border insolvency issues and implications for the parent company.
